Terms and Conditions

1. Scope

These General Terms and Conditions (hereinafter “Terms”) apply to the use of the event discovery platform operated by Kulvio UG (haftungsbeschränkt), Hanauer Landstraße 291B, 60314 Frankfurt am Main (hereinafter “Kulvio” or “Provider”) at kulvio.de (hereinafter “Platform”).

By using the Platform, the user agrees to these Terms. Deviating terms of the user are not recognized unless the Provider expressly agrees to their validity in writing.

2. Description of Services

Kulvio operates a platform for discovering local events. Users can discover events, view event details, and save events to personal bookmark lists.

Kulvio is not the organizer of listed events and does not act as a ticket seller or intermediary. The Provider does not become a contracting party in agreements between event organizers and attendees. The execution and content of each event lies solely within the responsibility of the respective organizer.

The Platform merely provides information about events and enables users to search and filter this information. There is no entitlement to the completeness or accuracy of the event listings.

3. Data Sources and Content

The event information displayed on the Platform is compiled and prepared by the Provider based on publicly available sources. Kulvio is not the author or creator of the event information itself.

Profiles for venues, cities, and artists are automatically generated from publicly available data. These profiles serve an informational purpose only and do not constitute a business relationship, endorsement, or partnership with the named persons, places, or institutions.

If you are featured in an automatically created profile and do not agree with the representation, you may contact us at any time at kontakt@kulvio.de . We will promptly remove or adjust your profile upon request.

4. Use of the Platform

The use of the Platform for discovering events is free of charge and does not require registration. Certain features (e.g., bookmarks, event reporting) may require free registration.

The Provider reserves the right to restrict, modify, or discontinue access to the Platform at any time, in particular for technical or legal reasons. There is no entitlement to permanent availability of the Platform.

5. Event Information and Warranty

Event information on Kulvio is based on publicly available information and compiled by the Provider to the best of its knowledge.

Kulvio does not guarantee the accuracy, completeness, or timeliness of the displayed event information. In particular, event details such as date, time, location, program, and prices may change at short notice, or events may be cancelled without prior notice.

Price information (such as “Free”, price ranges, or individual prices) is displayed to the best of our knowledge but is non-binding. The information provided by the respective organizer is always authoritative.

Users are advised to always verify event details directly with the respective organizer or on the official event website before attending an event.

6. Liability

The Provider is not liable for the proper execution, cancellation, or modification of events, or for damages arising from participation in events or reliance on the accuracy of information displayed on the Platform.

The Provider's liability for own fault is limited to intent and gross negligence. In case of breach of material contractual obligations (cardinal obligations), the Provider is also liable for slight negligence, but limited to the foreseeable, contract-typical damage.

The above limitations of liability do not apply to damages resulting from injury to life, body, or health, or to liability under the Product Liability Act.

7. External Links and Third-Party Content

The Platform may contain links to external websites, in particular to ticket providers, organizer websites, and official event pages. The Provider has no influence over the content of these external sites and assumes no responsibility for them.

The respective operator is always responsible for the content of linked sites. Linking does not constitute an endorsement or approval of the linked content by the Provider. When clicking external links, you leave the Platform — the terms of use and privacy policies of the respective third party apply.

8. Intellectual Property and Database Protection

The design, layout, source code, logo, and compilation of Platform content are protected by copyright and owned by the Provider. The database of event information compiled on the Platform is protected under § 87a ff. UrhG (German Copyright Act — database maker's right).

The systematic or automated collection of Platform content (web scraping, data mining, automated queries) is prohibited without prior written consent from the Provider. Commercial reuse of the content displayed on the Platform is likewise not permitted without authorization.

The use of the Platform for personal, non-commercial purposes (e.g., discovering and sharing individual events) is expressly permitted.

9. Reporting Incorrect Information

Users can report incorrect, outdated, or inappropriate event information using the report function on the respective event page or by email to kontakt@kulvio.de. Kulvio will review reported content and correct or remove it as appropriate.

10. Third-Party Rights

If you believe that content displayed on Kulvio infringes your rights (e.g., copyright, trademark, personality rights), please notify us immediately at kontakt@kulvio.de. We will review the matter and promptly remove or adjust affected content.

11. Data Protection

Information about the processing of personal data can be found in our Privacy Policy.

12. Changes to Terms

The Provider reserves the right to change these Terms at any time. The current version is available on the Platform. Registered users will be notified of material changes by email. Continued use of the Platform after changes to the Terms constitutes acceptance of the modified conditions.

13. Final Provisions

The laws of the Federal Republic of Germany shall apply, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). The place of jurisdiction is Frankfurt am Main, to the extent permitted by law.

Should individual provisions of these Terms be or become invalid, the validity of the remaining provisions shall remain unaffected. In place of the invalid provision, a valid provision shall apply that most closely reflects the economic purpose of the invalid provision.
